This Privacy Policy describes how Yonex Corporation d/b/a Yonex U.S.A. (“Yonex,” “we,” or “us”) collect, use, disclose, and otherwise process information about you. This Privacy Policy applies to information we collect when you access or use our websites, and other online products and services that link to this Privacy Policy (collectively, our “Services”) and when you otherwise interact with us, such as at events, through our customer support channels, or on social media. We may provide different or additional notices of our privacy practices for certain offerings, in which case those notices will supplement or replace the disclosures in this Privacy Policy.
We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. If we make material changes, we will provide you with additional notice (such as by adding a statement to the Services or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.

· Personal information does not include deidentified information or aggregate consumer information, which Yonex uses and discloses in accordance with applicable law.
Sources of Information
Yonex obtains the categories of personal information listed above from the following categories of sources:
· Directly from you. For example, we collect information directly from you when you create an account, make a purchase, fill out a form, submit or post content through our Services (including product reviews and other user-generated content), communicate with us via third-party platforms, participate in a contest, sweepstakes, or promotion, sign up for marketing communications from us, request customer support, through the mail, or otherwise communicate with us.
· Indirectly from you or your device when you interact with us or our Services, such as activity or usage information. For example, from observing your actions on our website or from information your computer transmits when interacting with our website, among other things. In addition, when you make, exchange, or return a purchase, we collect information about the transaction, such as product details, purchase price, and the date and location of the transaction.
· Affiliate entities. For example, our affiliate entities may give us information about you such as products and services you purchase and your use of our services.
· Our business partners and vendors. For example, forms or surveys you complete or products and services you purchase.
DISCLOSURE OF INFORMATION
We may disclose your information as described in this Privacy Policy (e.g., with our third-party service providers; to comply with legal obligations; to protect and defend our rights and property) or with your permission. Further Details About Those to Whom We Disclose Personal Information
· Service Providers and Contractors. We communicate personal information to service providers, vendors, consultants, and contractors that need access to such information to perform services on our behalf. The types of service providers to whom we disclose personal information include service providers, such as: web hosting, shipping and delivery, payment processing, financing, customer service, analytics, account service providers, legal service providers, the provision of IT and security services, marketing and advertising, reporting and analytics, and fraud prevention, as applicable.
· Affiliates, Subsidiaries, and Employees. Personal information is disclosed between and among Yonex and our parents, affiliates, subsidiaries, and other companies under common control and ownership, and employees who need to know the information.
· Advertising Partners: We disclose personal information to third parties for the marketing and advertising purposes described above. For more information about the cookies and other tracking technologies we use, and the choices and rights available to you, see the Your Privacy Rights section below.
· Other Users / The Public. If you provide a product review or otherwise post content on our Services, the public/other users of our Services will be able to see this information.
· Government Authorities, Regulators, and Similar Third Parties (collectively, “Government Entities”): We communicate personal information to courts, government authorities, independent external advisors, and internal compliance and investigation teams if we believe such disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process.
We also disclose the above information with the following categories of third parties:
· Professional Advisors: We communicate information about you to our professional advisors, including accountants, auditors, lawyers, insurers, and bankers. We only permit these advisors to process your personal information for specified purposes and, as appropriate, in accordance with our instructions and the provisions of this Privacy Policy and applicable law.
· Other Third Parties: In certain limited circumstances, we disclose your personal information to other third parties, including: (i) to comply with our obligations; (ii) to cooperate with law enforcement or national security investigations, requests and legal processes, such as court orders or subpoenas, as well as threats to the health or safety or any person or of our systems or services; (iii) protect your, Yonex’s, or others’ rights, property, or safety; (iii) enforce our policies or contracts; (iv) assist with an investigation or prosecution of suspected or actual illegal activity; (v) in connection with, or during negotiations of, any merger, joint venture, sale of company assets, financing, transition of service to another entity, or acquisition of all or a portion of our business, assets or stock by another company (including in connection with any bankruptcy or similar proceedings); and (vi) with you consent and at your direction. In certain circumstances and only as necessary in connection with business operations, work contact details may be provided to customers, potential customers, and other third parties, where the disclosure is required by role.
· Aggregated or De-identified Information: We also use and disclose aggregated or de-identified information that cannot be reasonably used to identify you. We maintain and use this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.
TARGETED ADVERTISING AND ANALYTICS
We engage others to provide analytics services, serve advertisements, and perform related services across the web and in mobile applications. To do this, Yonex and these partners may use cookies, pixels, SDKs, and similar technologies to collect information about your use of our Services and other websites and mobile apps, including your device identifiers, IP address, web browser and mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, order information, items added to cart, and conversion information. This information is used to deliver advertising targeted to you on other companies’ websites and mobile apps, understand the effectiveness of this advertising, analyze and track data, determine the popularity of certain content, and better understand your activity.
Depending on where you reside, you can opt out of ad targeting through cookies and similar technologies on our website by following the prompts behind the Your Privacy Choices link in the site footer. Your opt-out choice will be linked to your browser only; therefore, you will need to renew your opt-out choice if you visit our website from a new device or browser, or if you clear your browser’s cookies.
In addition to ad targeting activities that rely on cookies and similar technologies, we work with advertising partners to translate other identifiers, such as your email address or phone number, into a unique identifier (called a hashed value) that such partners can then use to show ads that are more relevant to you across the web and in mobile apps. Depending on where you reside, you may opt out of these disclosures by filling out our web form Privacy Rights Request Form.
The activities described in this section may constitute “targeted advertising,” “sharing,” or “selling” under certain privacy laws. See the Additional Information for California and Texas State Notice and Privacy Rights section below for details.

How We Use Google Analytics
We use Google Analytics to recognize you and link the devices you use when you visit our Sites or services on your browser or mobile device, log in to your account on our services, or otherwise engage with us. We share a unique identifier, like a user ID or hashed email address, with Google to facilitate the service. Google Analytics allows us to better understand how our users interact with our service and to tailor our content to you. We may also utilize certain forms of display advertising and other advanced features through Google Analytics. These features enable us to use first-party cookies (such as the Google Analytics cookie) to inform, optimize, and display ads based on your past visits to the services. DATA RETENTION
We store personal information associated with your account for as long as your account remains active. If you close your account, we will delete personal information related to your account within 30 days; otherwise, we will delete this information after two years of account inactivity or in accordance with our record retention policy. We store other personal information for as long as necessary to carry out the purposes for which we originally collected it and for other business purposes explained in this Privacy Policy.
NO COLLECTION OF PERSONAL INFORMATION FROM CHILDREN UNDER 13
Yonex’s websites are not targeted to children under 13 years old, and it does not intend to collect personal information from children under the age of thirteen (13). If you are aware of a user under the age of thirteen (13) who has provided personal information to Yonex, please contact us at privacy@mail.yonex.com to delete their information.
YOUR CHOICES
Account Information
You can access, correct, and delete certain information stored within your Yonex account at any time by logging in and navigating to the settings menu.
Cookies and Similar Tracking Technologies
Yonex uses cookies and similar tracking technologies, as described above. You can usually adjust your browser settings to remove or reject browser cookies. Depending on the state of residence where you reside, you can also adjust certain cookie settings by clicking on the Your Privacy Choices link in the site footer. Please note that removing or rejecting cookies could affect some of the functionality of our Services.
Communications Preferences
You may opt out of receiving promotional emails from Yonex by following the instructions in those communications. If you opt out, we may still send you non-promotional emails, such as those about your account or orders.
ADDITIONAL INFORMATION FOR CALIFORNIA AND TEXAS STATE NOTICE AND PRIVACY RIGHTS
Individuals Residing in Certain U.S. States
Some U.S. states have enacted privacy laws, such as the California Consumer Privacy Act (Cal. Civ. Code § 1798.100 et seq.) (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), and the Texas Data Privacy and Security Act, that grant their residents certain rights and require specific disclosures (“State Privacy Laws”).
So, in addition to the notices provided above about how we collect, use, and disclose personal information or personal data as defined under the applicable state privacy laws (“Personal Information”) about you, if you reside in California and Texas, this section applies to you.
Targeted Advertising and California Sales and Sharing of Personal Information
· California law requires that we provide transparency about personal information we “sell” or “share.” “Sale,” for the purposes of the CCPA, broadly means scenarios in which we have disclosed personal information with partners in exchange for valuable consideration, while “sharing” means we have disclosed information to a third party for cross-context behavioral advertising. In addition, the CCPA has been interpreted to deem this “sharing” to also be a form of “sale.” Accordingly, in the preceding twelve (12) months, we have “sold” or “shared” your personal information to or with third parties for cross-context behavioral advertising, such as targeting of advertising to you based on your personal information obtained from your activity across businesses, websites, apps, and services other than our Services.
· Similarly, Texas requires that we notify you if we use your information for Targeted Advertising. “Targeted Advertising” means displaying advertisements to you where the advertisement is selected based on Personal Information obtained from your activities over time and across non-affiliated websites or online applications to predict your preferences or interests. As described in the table above, we use and disclose your Personal Information for Targeted Advertising.
We do not engage in sales, sharing, or targeted advertising using personal information about consumers we know to be under the age of 16.

Global Privacy Control
If you reside in California or Texas, you can also opt out by visiting our websites with a legally recognized universal opt-out signal enabled, such as the Global Privacy Control. If you are not logged into your account with us, our processing of the signal will be limited to cookie-based sales, sharing, and targeted advertising for the specific browser or device that you are using.
Sensitive Personal Information
State Privacy Laws provide certain rights with respect to our collection of “Sensitive Personal Information,” as defined by those laws. We will only use such Sensitive Personal Information for the purposes set out in this Privacy Policy, or as otherwise described to you at the time such information is collected, and in accordance with applicable law. We obtain consent to collect that information in those states where consent is required. Moreover, each state’s privacy laws may consider different pieces of information to be “Sensitive Personal Information.” When we notify residents of certain states that we collect Sensitive Personal Information, that means that we collect Sensitive Personal Information within the meaning of the law of that particular state. We collect Sensitive Personal Information in California and Texas. We collect the types of Sensitive Personal Information, to the extent included in your state’s definition, listed above in the Notice of Collection and Uses of Information section. We do not use or disclose Sensitive Personal Information to infer characteristics about you.
Your Privacy Rights
Subject to certain limitations, and depending on your state of residence, you may have the right to: (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information collected from or about you, (3) request correction of inaccurate personal information; and (4) opt out of any “sales, or “sharing” of your Personal Information that may be occurring or uses of your Personal Information for targeted advertising.

You may opt out of activities that we engage in that constitute “targeted advertising,” “sharing,” or “sales” of personal information under the State Privacy Laws by:

Nondiscrimination
You have the right not to be discriminated against for exercising any of your privacy rights.
Appeals
If we deny your request, you may appeal our decision by contacting us at privacy@mail.yonex.com. If you have concerns about the result of an appeal, you may contact the attorney general in the state where you reside.
Authorized Agents
If you are an authorized agent seeking to make a request to opt out of sales, sharing, or targeted advertising on behalf of a consumer, please fill out this Privacy Rights Request Form.
If you reside in California, you may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may contact the individual who is the subject of the request to verify their own identity or confirm the authorized agent has permission to submit the request. INTERNATIONAL DATA TRANSFERS
Yonex is based in the United States, and we and our service providers process and store personal information on servers located in the United States and other countries. Where required by law, whenever we make restricted international transfers of personal information, we take steps to ensure that your personal information receives an adequate level of protection in accordance with applicable laws (by putting in place appropriate safeguards, such as contractual clauses) or ensure that we can rely on an appropriate derogation under data protection laws.
